Robert Sarrazin and Darlind Jean - April 18, 2011Case #33917Robert Sarrazin and Darlind Jean were convicted of second degree murder for the 1998 shooting of Apaid Noel in front of an Ottawa nightclub. The Crown asserted that Sarrazin and Jean wanted to settle a dispute with rival gang member Noel, who died a month after the shooting from a blood clot. An autopsy showed a trace amount of cocaine in his blood.Sarrazin and Jean suggested that Noel’s death may have been caused by complications related to his ingestion of cocaine. The respondents won a second trial on appeal, but they were once again convicted of second degree murder. They were sentenced to life imprisonment without eligibility for parole for 18 years.The respondents argue that the trial judge failed to instruct the jury that it could find them guilty of attempted murder if there was reasonable doubt about the cause of the victim’s death.
