May 17, 2010 - Case number 33450
Jurisprudence Michell Rayal Levigne v. Her Majesty the Queen (Alberta) - May 17, 2010Case number 33450 Michell Rayal Levigne was acquitted of Internet luring in 2008. Levigne was charged after having online conversations with someone claiming to be a thirteen-year-old boy. "etownjessy13" was in fact an undercover police officer who communicated with Levigne as if he was 13. The conversations took place in an adult internet chat room, where users' profiles stated that they were 18 years of age or older. Levigne did not take any steps to verify his chat partner’s true age. He argued that he knew he was not really communicating with a thirteen-year-old boy. The Supreme Court must decide the extent to which online users have to verify the age of the person they are communicating with.
