Supreme Court Hearings Workers' Compensation Board of British Columbia v. Guiseppe Figliola, Kimberley Sallis, Barry Dearden and the British Columbia Human Rights Tribunal - March 16, 2011Case #33648Guiseppe Figliola, Kimberley Sallis and Barry Dearden suffer from chronic pain due to work-related injuries. They argue that the chronic pain compensation policy of the Workers' Compensation Board of British Columbia (WCB) is discriminatory. The WCB’s review division ruled that the policy was not discriminatory, leading the individual respondents to file complaints with the B.C. Human Rights Tribunal. One of the issues in this appeal is the Tribunal’s decision to re-hear complaints that have already been dealt with by the WCB’s review division.
