They argue that the chronic pain compensation policy of the Workers' Compensation Board of British Columbia (WCB) is discriminatory. The WCB’s review division ruled that the policy was not discriminatory, leading the individual respondents to file complaints with the B.C. Human Rights Tribunal. One of the issues in this appeal is the Tribunal’s decision to re-hear complaints that have already been dealt with by the WCB’s review division.
