Vancouver Airport Centre Ltd., et al. - October 6, 2010Case #33280One of the issues in this appeal is the failure to disclose an alleged conflict of interest. The Vancouver Airport Centre (VAC) opened a number of airport hotels. Sharbern invested in the Hilton Hotel and later expressed concern over VAC’s management of the near-by Marriott Hotel. Sharbern alleged that the financial arrangements for the Marriott Hotel had significant advantages. Sharbern contended that VAC's management of the competing Marriott created a conflict which violated its fiduciary obligations.
