Elder Advocates of Alberta Society, et al. - January 27, 2011Case #33551Among the issues in this appeal is whether the Alberta government breached its fiduciary duty to residents of long-term care facilitiesIn 2005, the Elder Advocates of Alberta Society filed a class-action lawsuit against the provincial government and nine regional health authorities. The $128-million lawsuit was filed after Alberta increased long-term care fees for nursing home residents by 40 per cent in 2003. The plaintiffs argue that they paid for services that are insured under the Canada Health Act.
