Her Majesty the Queen - December 15, 2010Case #33476The Supreme Court must decide if the Crown has the power to revoke a plea agreement.In 2006, Wade and Karen Andriashek were killed and their seven-year-old son Jessie was injured after their car was hit by Olga Nixon’s car. Nixon was charged with impaired driving causing death and bodily harm. A plea bargain was reached where Nixon would plead guilty to the lesser charge of careless driving. The Crown withdrew the plea agreement before a guilty plea was entered. Nixon alleges that the revoked agreement is an abuse of process and breaches her Charter rights.
