we’ve uncovered new fact missing in a report on a state police officer arrested for drunk driving. there was a child in the officer's car, but that was never mentioned in the report. investigative reporter jeremy jojola went digging and joins us live with what he found. jeremy. we often see people busted for driving drunk with their kids in the car get charged with child abuse or child endagerment too... but that is not happening with state police officer daniel barde. the 33-year-old state police officer was pulled over by a fellow state police officer near belen tuesday evening. the police report and court documents say barde failed field sobriety tests. the documents also say there was an open bottle of jim beam in his truck...he refused to give a breathalyzer, according to documents, and was charged with aggravated dwi. also in his truck ....a little boy.... but the child was not mentioned in the police report....the child was also not mentioned in the press release sent out by state police. a department spokesperson did confirm there was a little boy in barde's truck.... state police tell us it was the district attorneys office's decision not to charge barde with child abuse or endangerment...and that's why the boy may have not been included in the police report, according to a spokesperson. district attorney lemuel martinez told us over the phone today, the supre court doesn't allow that charge with drunk driving. when we told him we see it all the time here in albuquerque ....he said the charges could be filed later in front of a grand jury.
